This paper presents a delimited analysis of the decision by Judge Robert Peckham to make permanent his injunction against the employment of intelligence tests in the placement of black students into Educably Mentally Retarded (EMR) programs (Lamy P. v Wilson Riles,Note 1). The previous injunction had been extended to the placement of all students, and it is expected that the same extension will prevail. California schools will have to make do, as they have since the initial injunction, with other evidence of the appropriateness of EMR placement of a student.
