PI009: Protecting Your Schools from Litigation Involving Student Suicide


Key issues involved in litigation regarding a school’s possible liability for a student’s suicide will be discussed. We will outline recent court cases to help highlight the roles of negligence, foreseeability, immunity, state-created danger, bullying, postvention concerns, and ‘special relationships’ in these lawsuits. Emphasis will be placed on how these cases demonstrate the actions that school psychologists must enact in order to best protect schools from liability concerns - and more importantly, a student’s suicide.
